These Terms of Service (“Terms”) govern your use of the ICONX Talent mobile application (the “App”), operated by ICONX (“ICONX”, “we”, “us”), Dubai, United Arab Emirates. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old to use the App. By using it, you confirm that you meet this requirement and that the information you provide is accurate, current, and your own.
2. Your account
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You agree to provide accurate profile information and to keep it up to date.
- Notify us promptly of any unauthorised use of your account at talent@iconxglobaltalent.com.
3. Your content
You retain ownership of the profile details, photos, and videos you upload (“Your Content”). By submitting Your Content, you grant ICONX a non-exclusive licence to store, display, and process it for the purpose of reviewing your profile and considering and promoting you for talent representation and opportunities.
You represent and warrant that:
- You own or have the necessary rights to all of Your Content, and it does not infringe the rights of any third party.
- Your Content is accurate and depicts you, and you have consent from anyone else featured in it.
4. Acceptable use
You agree not to:
- Impersonate any person or misrepresent your identity, age, or experience.
- Upload content that is unlawful, obscene, defamatory, harassing, or that infringes intellectual property or privacy rights.
- Use the App for any fraudulent, harmful, or unauthorised commercial purpose.
- Attempt to disrupt, reverse-engineer, or gain unauthorised access to the App or its systems.
5. No guarantee of representation or work
Creating a profile or submitting a portfolio does not guarantee representation, casting, bookings, or any engagement or income. Selection and representation are at ICONX’s sole discretion and subject to separate agreements.
6. Intellectual property
The App, the ICONX name and logo, and all related software and content (excluding Your Content) are owned by ICONX and protected by applicable laws. You may not copy, modify, or distribute them without our permission.
7. Suspension and termination
We may suspend or terminate your access if you breach these Terms or misuse the App. You may stop using the App and delete your account at any time from the Profile tab (Delete account). Deletion permanently removes your account and associated data as described in our Privacy Policy.
8. Disclaimers
The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, ICONX shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or opportunities, arising from your use of or inability to use the App.
10. Governing law
These Terms are governed by the laws of the United Arab Emirates, and you agree to the exclusive jurisdiction of the courts of Dubai for any dispute arising from them.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the App after changes take effect means you accept the updated Terms.
